⬩⬩✦⬩⬩ TERMS OF SERVICE ⬩⬩✦⬩⬩

BY COMMISSIONING ME, YOU AGREE TO MY TERMS OF SERVICE & PROCESS. PLEASE, READ CAREFULLY.

✦ GENERAL TERMS

• You must be, at the very least, 18 years old or older to commission work from me.
• You acknowledge that I'm a digital illustrator and my work is digital only, meaning there won't be any shipping of physical goods.
• As the artist I still maintain all and absolute rights to my works; this includes publishing the work on my socials, adding it as a part of my portfolio, including the work in artbooks and other projects.
• Credits to me (©AzaleaArchivist; the artist) or a link tracing back to one of my socials must be explicitly given anytime the art is showcased.
• DO NOT use my artwork for anything AI related, NFTs, and cryptocurrency, nor claim it as your own. I also strictly prohibit usage of my illustrations for AI learning.
• I reserve the right to stream or post on social media the WIP and final artwork unless requested otherwise (NDA) by the commissioner.

✦ USAGE AND RIGHTS

• My work is for private use only. I do not allow my art to be used for unauthorized commercial purposes or profit unless otherwise formerly accorded—by definition, must be agreed upon by me, the artist, and the commissioner.
• VTubers and streamers may request non-commercial purpose illustrations for personal use only (icons, banners); this does not include reposting of the artwork. If you'd like to be granted exclusivity for reposting the artwork and using it for derivative content such as advertisement and stream schedule or graphics (with credits linking back to any of my socials), please inquire about a commercial use illustration.

✦ PAYMENT INFORMATION

• Payments are upfront via PayPal invoice and in US Dollars ($). Prices listed will include PayPal fees.
• Full payment is required to start the commission, while partial payments can be discussed for commercial works.
• Commission will be canceled if the invoice isn't paid within 72 hours without explanation.
• All listed prices are base price and for personal use only without the inclusion of other fees.

⬩ OTHER FEES

• 6% PayPal fees to cover tax.
• Commercial fees range from 200% to 300% of base price such as branding, v-tubing, merchandise (art prints, charms, stickers, pins) etc.
• For a nondisclosure agreement (NDA), it's an additional 20% of base price.
• For rushed commissions, it's an additional 100%~200% of base price depending on time constraints and the complexity of the commission, and will be discussed in detail privately—either through Twitter DMs or via e-mail.

✦ CANCELLATIONS & REFUND POLICY

• I reserve the right to deny or cancel any commission I can't fulfill within my capabilities.
• If you wish to cancel your commission, I'll refund 100%. However, if in the situation where I've already started on your request (sketch/line process), 50% of the the total commission will be refunded. If commission is either in the process of being colored and or finished, then a request for a refund will be declined.

✦ WORK PROCESS & REVISIONS

• Minor revisions are only allowed up to three times during the sketching process (ex. face expression, clothing detail, accessory), and one major revision (ex. pose change, composition)
• Once rendered, any changes will have additional charges depending on the desired modification.
• Mistakes on my part such in sketch and render phase will be fixed for free, but not if it was caused by unclear references sent by the commissioner.

⬩ TURNAROUND TIME

• The commission may take up from 2 weeks to 2 months to be completed (unless stated/agreed otherwise) as it strongly depends on the type of commission, complexity and your turn in queue. Consider availing the rush service if you want to avoid waiting.

• After reading the T.O.S. and selecting the type of commission you want to request, please fill out the form and send it to Twitter DMs!

⬩ IMPORTANT NOTES

• Be sure to provide complete references of your character. (ex. fullbody, base colors, details.)
• Written character descriptions without references will be declined (unless custom design is requested and accepted).
• AI generated references will be declined.
